Terms of Service

Welcome to Pomegranate. These Terms of Service ("Terms") govern your access to and use of the Pomegranate mobile application (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement of a parent or guardian.

2. Your Account

• You must provide accurate information when creating an account and keep your login credentials secure.
• You are responsible for all activity that occurs under your account.
• You may delete your account at any time through the App's settings or by contacting us.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of applicable law
• Upload content that infringes someone else's intellectual property, is defamatory, obscene, or otherwise objectionable
• Attempt to reverse-engineer, decompile, or interfere with the App's functioning
• Use automated means (bots, scrapers) to access the App without written permission
• Misuse the AI features to generate harmful, illegal, or abusive content

4. User Content

Your Content

Recipes, photos, notes, and other content you create or upload ("User Content") remain yours. By submitting User Content, you grant us a limited, non-exclusive license to store, display, and process it solely to operate and improve the App.

Imported Content

If you import recipes from third-party websites or social media, you are responsible for ensuring you have the right to do so for personal use.

Content Removal

We may remove User Content that violates these Terms or applicable law.

5. AI-Generated Content

The App includes AI-powered features (such as ingredient substitution suggestions) powered by a third-party AI provider (OpenAI). AI-generated suggestions are provided for inspiration and convenience only and may occasionally be inaccurate or unsuitable for your dietary needs or allergies. You are responsible for verifying that any AI-suggested substitution is safe for your specific dietary restrictions before consuming it.

6. Subscriptions & Payments

• Certain features may require a paid subscription ("Premium"), billed through the Apple App Store or Google Play and managed via RevenueCat.
• Subscription pricing and terms will be clearly displayed before purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Manage or cancel through your Apple ID or Google Play account settings.
• Refunds are subject to Apple's and Google's respective refund policies.

7. Intellectual Property

The App, including its design, logo, and underlying software (excluding your User Content), is owned by us or our licensors. You may not copy, modify, distribute, or create derivative works from the App without permission.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

Nutritional & Dietary Disclaimer: Recipe information, nutritional estimates, and AI-generated ingredient substitutions are provided for general informational purposes only and do not constitute medical or dietary advice. Consult a qualified healthcare provider regarding any specific dietary needs, allergies, or health conditions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING ALLERGIC REACTIONS, FOOD-RELATED ILLNESS, OR LOSS OF DATA. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability) will continue to apply.

12. Changes to the App or Terms

We may update the App and these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of [New South Wales, Australia], without regard to conflict-of-law principles, unless otherwise required by applicable consumer protection law in your country of residence.
